Main Responsibilities of Fujian Provincial Department of Foreign Trade and Economic Cooperation

1. To instruct, coordinate and comprehensively manage foreign trade and economic cooperation in the Province;
- to draft the development strategies and plans for foreign trade and international economic cooperation;
- to draft and implement detailed enforcement rules and regulations and organize the implementation according to related national laws and regulations; and
- to study and put forward the opinions on the consistency of the Provincial economic and trade laws, regulations and policies, and the international economic and trade treaties and regulations.

2. To study the new situation and problems stemming from the opening-up drive and suggest relevant counter measures;
- to study and draft policies related to the opening-up drive;
- to supervise and coordinate the implementation of the opening-up policies;
- to coordinate the exploration of international markets;
- to take the lead in organizing cooperation between customs and trade, banking and trade, taxation and trade, science and trade, inspection and trade, and insurance and trade;
- to participate in the formulation of policy for investigation and research on taxation, credit and loans, and prices,
- to take part in the management of export tax refunds and the examination of export foreign exchange settlement;
- to manage the business capital and special funds related to all foreign economic and trade business.

3. To carry out and implement management methods and directories of import and export commodities;
- to organize and implement the import and export quota plans and determine the quotas;
- to issue permit and licenses according to relevant National regulations;
- to execute the import and export commodities quota bid-inviting policies;
- to examine and submit for approval the import tariff quotas for certain agricultural products;
- to compile and report on import and export plans for the bulk raw materials and major industrial products, and re-distribute and manage the index of the import and export plans of the raw materials of industrial products assigned by the State to the Province;
- to coordinate and manage the Provincial foreign processing trade, and to coordinate and manage the business orders of import and export commodities in the Province.

4. To organize and implement the policies concerning foreign technology trade, national import and export control and encourage the export of technology and completed equipment;
- to draft and implement the Provincial corresponding supplementary policies;
- to accelerate the establishment of Provincial import and export trade standardized systems;
- to supervise, according to the laws, the introduction of technology, the import of equipment, the technologies under the state export restriction, and the export and re-export of introduced technology;
- to issue export permits and licenses related to anti-proliferation issues in accordance with the laws;
- to supervise and coordinate scientific and technological development and progress in the foreign economies and trade;
- to coordinate and carry out the protection of technology trade and the foreign intellectual property rights.

5. To carry out and implement multi-lateral and bilateral economic and trade cooperation policies and prepare the relevant documents;
- to handle the issues concerning trans-national or regional economic and trade relations under the supervision of the Ministry of Commerce,
- to manage economic and trade activities between the Province and those countries which have not established the formal diplomatic relationship with China;
- to undertake Provincial business under the framework of the WTO, and to be responsible for negotiations and agreement-signing related to economic and trade cooperation between Fujian and its international friendship cities and the international economic and trade organizations, and organize the implementation of the same.

6. To direct the relevant work of the Provincial economic and business institutions located abroad, and to keep in contact with the institutions of the multi-lateral economic and trade organizations, and foreign governmental business institutions located in the Province.

7. To organize and coordinate the anti-dumping, anti-subsidizing and guarantee measures and other work related to fair import and export trade;
- to set up the early warning system for fair import and export trade;
- to organize industrial damage investigation, and
- to direct and coordinate responses to foreign anti-dumping, anti-subsidizing, and guarantee charges against the export commodities of the Province and such related work.

8. To conduct macro-control over foreign investments in the Province;
- to analyze and study the foreign investment situation in the Province and report regularly to the Provincial Government and the Ministry of Commerce on relevant developments and related proposals;
- to implement foreign investment policies;
- to draft, carry out and implement the foreign investment policies and regulations;
- to participate in the drafting of medium and long term development plans for foreign investment utilization;
- to manage, examine and approve on the establishment or amendment of foreign-invested enterprises;
- to check and submit major alterations to contracts, articles of association and special issues stipulated by the laws and regulations concerning major large foreign investment projects;
- to supervise the execution of the relevant laws and regulations, contracts and articles of foreign-invested enterprises;
- to direct and manage foreign investment invitations, investment promotions and import and export throughout whole Province.

9. To comprehensively coordinate and direct specific work related to the economic and technological development zones;
- to be responsible for the drafting of the development plans and management measures of various economic development zones and organize their implementation;
- to be in charge of the examination and submission for approval of the establishment of a development zones and the preliminary examination for the establishment of foreign investment development zones, and
- to coordinate and monitor project developments and the investment invitations in the economic development zones.

10. To be responsible for the foreign economic cooperation in the Province;
- to implement the foreign economic cooperation policies;
- to direct and supervise such businesses as foreign contracting projects, labor cooperation and design consultancies;
- to carry out management methods and specific measures for investment overseas;
- to examine the establishment of enterprises (excluding financial investment enterprises) outside the Province and implement the related supervision and management;
- to conduct overall management over the Provincial overseas aid and the acceptance of aid;
- to keep in contact with the teams supervising Provincial enterprises located in Hong Kong and Macao, and
to direct and coordinate the overseas foreign economy and trade institutions at Provincial level.

11. To implement economic and trade policies and long-term and medium-term trade plan related to trade in the Hong Kong Special Administrative Region and Macao SAR and Taiwan region;
- to conduct economic and trade negotiations and sign related documents with the economic and trade administration in Hong Kong SAR and Macao SAR as well as the authorized organizations in Taiwan;
- to take responsibility for liaison system work between Fujian and Hong Kong SAR and Macao SAR;
- to organize trade contacts with Taiwan and participate in settlement of issues related to Taiwan in multi-lateral and bilateral trade.

12. To be responsible for examining relevant procedures for overseas visits for the purpose of economy and trade for officials of, or lower than director-ranking in the Provincial government and its subordinate companies;
- to be responsible for the confirmation of the visa information of the foreign businessmen who wish to conduct economic and trade activities in the Province at the invitation of departments under the Provincial government,
- to contact and coordinate foreign economic and trade activities in departments such as Fujian Customs, Commodity Inspection and Quarantine Bureau and The Bank of China.

13. To draft and implement the talents program in foreign economic and trade for the Province;
- to coordinate educational training of talented persons in the foreign economic and trade;
- to manage in general exchanges of talents;
- to be responsible for implementing the professional qualification system for international business;
- to be responsible for personnel selection and dispatching for overseas economic and business institutions and the representative offices in international organizations and the related work in management, and
- to direct the work of such foreign economy and trade intermediaries as import and export chambers and the relevant associations and institutes.

14. To undertake any other tasks assigned by the Provincial government.
